Welcome to Volcan Coffee. These Terms of Service (“Terms”) govern your access to and use of the Volcan Coffee website, online store, products, services, content, and related features (collectively, the “Services”).
Throughout these Terms, the terms “Volcan Coffee,” “we,” “us,” and “our” refer to Volcan Coffee. The terms “you” and “your” refer to any visitor, customer, purchaser, or other user of the Services.
By visiting our website, placing an order, creating an account, or otherwise using our Services, you agree to be bound by these Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies or notices posted on our website.

Volcan Coffee is responsible for the products offered through our store and for administering our own store policies.

We make reasonable efforts to accurately display and describe our products, including product names, roast profiles, tasting notes, weights, packaging, photographs, and other information.
Because coffee is an agricultural product, natural variations may occur between harvests, lots, origins, and roast batches. Flavor, aroma, appearance, and other characteristics may vary.
Product photographs and colors may also appear differently depending on your screen or device.
All products are subject to availability. We reserve the right to limit quantities, discontinue products, change product offerings, or refuse or limit sales where reasonably necessary.
We do not guarantee that any particular coffee, origin, blend, roast, lot, packaging style, or product will remain continuously available.
4. Prices
All prices displayed on our website are stated in U.S. dollars unless otherwise indicated.
Prices are subject to change without notice.
We reserve the right to correct pricing, typographical, descriptive, or other errors at any time, including after an order has been submitted.
If an obvious pricing or listing error affects an order, we may contact you to provide the opportunity to proceed at the corrected price or cancel the affected item or order.
Discounts, promotional offers, family codes, promotional codes, and other special pricing may be subject to separate eligibility requirements, exclusions, expiration dates, usage limits, or other conditions.
Unless expressly stated otherwise, discounts may not be combined.
5. Orders and Acceptance
Submitting an order does not necessarily constitute our acceptance of that order.
We reserve the right, in our reasonable discretion, to accept, decline, cancel, or limit an order for reasons including, but not limited to:

incorrect pricing or product information;
payment authorization issues;
shipping restrictions;

If we cancel an order after payment has been collected, we will refund the amount paid for the canceled portion of the order to the original method of payment.

are accurate before completing your purchase.
Volcan Coffee is not responsible for delays, misdelivery, or additional costs resulting from incomplete or incorrect information supplied by the customer, except where otherwise required by applicable law.
If you discover an error after submitting an order, contact us promptly at volcancoffee.info@gmail.com. We will make reasonable efforts to assist, but changes cannot be guaranteed once fulfillment or shipment has begun.
7. Payment
You agree to provide valid payment information and authorize us and our applicable payment processors to charge the total amount shown at checkout, including applicable taxes, shipping charges, and other disclosed charges.
Payment methods available at checkout may change from time to time.
We do not guarantee that any particular payment method will always be available.
Orders may be delayed, declined, or canceled if payment cannot be authorized or if additional verification is reasonably required.

The amount of tax charged may depend on factors including the type of product purchased and the customer’s delivery location.
9. Shipping and Delivery
Volcan Coffee currently ships within the United States to locations made available through our checkout process.
Shipping rates, available methods, free-shipping thresholds, and estimated delivery times are displayed at checkout or elsewhere on our website and may change from time to time.
Delivery estimates are estimates and are not guarantees unless expressly stated otherwise.
Delays may occur because of weather, carrier disruptions, holidays, incorrect addresses, high order volume, natural disasters, or other circumstances outside our reasonable control.
If we become aware that we cannot ship an order within a timeframe required by applicable law, we will handle the delay, cancellation, or refund in accordance with applicable legal requirements.
Once an order has been transferred to a shipping carrier, tracking and delivery may be subject to the carrier’s procedures and service limitations.

10. Returns and Refunds
Coffee is a food product and is subject to the return and refund terms described in our Return & Refund Policy.
By placing an order, you acknowledge and agree to the Return & Refund Policy in effect at the time of your purchase.
Nothing in these Terms is intended to limit rights or remedies that cannot legally be waived under applicable law.
11. Coffee Taste and Brewing Results
Coffee preparation and taste are influenced by numerous factors, including grind size, water quality, brewing method, equipment, ratios, temperature, storage, and individual preference.
Descriptions of flavor notes, aroma, body, acidity, sweetness, roast characteristics, or other sensory qualities are intended to help customers understand the general character of a coffee.
Individual tasting experiences may vary.
Unless otherwise required by law, personal taste preference alone does not constitute a defect in the product.
12. Coffee Concierge, Brewing Guidance, and Recommendations
From time to time, Volcan Coffee may provide brewing suggestions, equipment recommendations, coffee sourcing assistance, educational information, or other guidance.
Such information is provided for general informational purposes and as a customer service.
Recommendations may be based on preferences and information supplied by the customer, and results may vary based on equipment, technique, water, coffee, environment, and other factors.
References to third-party brewing equipment, grinders, accessories, manufacturers, or other products do not necessarily constitute an endorsement, warranty, or guarantee by Volcan Coffee.
13. Intellectual Property
The Volcan Coffee name, logos, marks, graphics, product names, packaging designs, photographs, artwork, website design, written content, slogans, product descriptions, and other original materials displayed through the Services are owned by, licensed to, or used with permission by Volcan Coffee and are protected by applicable intellectual property laws.
You may access and use our website for your personal, non-commercial use.
You may not, without our prior written permission:

republish;
distribute;
modify;
sell;
license;
commercially exploit;
create derivative works from; or
use in connection with another business
any protected Volcan Coffee content, branding, images, designs, or materials.

19. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VOLCAN COFFEE AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, VOLCAN COFFEE’S TOTAL LIABILITY ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO VOLCAN COFFEE FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.
THE LIMITATIONS IN THIS SECTION DO NOT APPLY WHERE SUCH LIMITATIONS ARE PROHIBITED BY LAW.
20. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Volcan Coffee and its owners, officers, employees, agents, affiliates, and service providers from third-party claims, liabilities, damages, losses, and reasonable costs arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person’s legal rights.
21. Force Majeure
Volcan Coffee will not be responsible for a delay or failure to perform caused by events reasonably beyond our control, including severe weather, natural disasters, fires, labor disruptions, transportation interruptions, carrier failures, governmental actions, supply shortages, power or telecommunications outages, or similar events.
Nothing in this provision limits any refund, cancellation, or other consumer right required by applicable law.

If any provision of these Terms is determined by a court of competent jurisdiction to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary.
The remaining provisions will remain in full force and effect.
23. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or of our right to enforce it later.

These Terms, together with the policies and notices incorporated by reference, constitute the agreement between you and Volcan Coffee regarding your use of the Services and purchases made through our website, except where separate written terms expressly apply.
25. Governing Law
These Terms and any dispute arising from or relating to them will be governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except to the extent otherwise required by applicable law.
Nothing in this section eliminates or limits consumer protections that cannot lawfully be waived.

Changes will become effective when posted unless otherwise stated or required by applicable law.
